Defense Witness: Zachary Zoz

Direct Exam: Lindsey Gutierrez

He lives in Fairfield Twp. and has known Ryan for 10 or 11 years and met him through Chris Kist, Ryan's roommate in college. They had season's tickets together for Bengals games and tailgated together before the games, along with another couple. He got to know Ryan "pretty well because they also played cards together and hung out together. He knew Sarah through Chris and Dana Kist, before she met Ryan.

He knew Ryan's dad was Gary Widmer, but didn't meet him until after Sarah's death. He thought Ryan and his dad had a limited relationship prior to that. He knew Jill, Ryan's mother, from playing cards at their house with them. He's known her for about 8 or 9 years.

Asked about Jill's drinking issues prior to Sarah's death, he said she would have a few drinks, occasionally. Ryan didn't drink excessively, just at tailgate parties. He said he never saw Ryan get angry or act hateful to Sarah. "He's probably the most laid back guy I know", he said.

The group would get together for birthdays, football games, and other social activities. He never was concerned with their relationship or the way Ryan talked to her. Ryan never was "hateful" to Sarah... "never, ever", he repeated.

He thought her sleeping habits were kind of odd because she fell asleep often when they were all together. They all went to Brazenhead Irish Pub for a birthday in April. Sarah was sitting in the corner of the booth with the other wives and "She snuggled up in the corner and fell asleep" -- "just kind of odd", he said. They were all talking and the pub was loud but yet she fell asleep. It was about 9 p.m. and Sarah had one drink and they weren't on their 2nd round yet.

She came to Bengals games one or two times a year. When the game started at 1 p.m. they would get there about 9 a.m. and by 11 a.m. she had climbed into the car and fell asleep.

At that point they found it funny, he said, and joked with her about it, but looking back now, it wasn't funny. He was aware of Sarah falling asleep at other times as well.   Nothing further.

Cross Exam: Travis Vieux

Vieux began by stating that they know each other professionally since Zoz is a criminal defense attorney.

Zoz repeated that he knew Ryan through Chris Kist, Ryan's former college roommate. He said he testified in the first trial, but not the second trial.

He didn't know what time Sarah went to bed, or what time she got up or went to work and he didn't know her nighttime sleeping habits or if allergies kept her awake at night.

Sarah went to Bengals games but wasn't a "huge" fan like the rest of the group. She usually only went to a game if there was an extra ticket. She fell asleep during the early morning tailgating, but didn't know if she fell asleep during the game because their seats weren't together.

He never heard her complain of chest pains, numbness or dizziness but she did complain of a headache once.

Vieux asked if Sarah was sitting in the middle of people at the Irish pub and falling asleep, and Zoz replied, "No, she was in a corner with people;   I saw her".  She leaned against the booth and fell asleep by 9:30 and slept for about 20 minutes. It was in April to celebrate birthdays. He said he stayed till about 11 p.m. and had a few beers, then he and his wife left.

At Bengals games they would sit around the back of the SUV to tailgate. He didn't know if she was drinking but she climbed in the SUV and fell asleep.   Nothing further.
